For example, Tier 4 visa sponsorship deals with student visas while Tier 2 visa sponsorship deals with work visas that people apply under the points-based system in order to work in the UK.
How to check if your degree qualifies you
There are two ways to check if your degree qualifies you for a Tier 2 visa.
First, you can look at what occupation codes are covered by your degree and see if they match any of those listed in Appendix J to The Immigration Rules.
Second, you can see if there is a shortage occupation that your degree qualifies you for and where it appears on list of shortage occupations in The Immigration Rules.
If either of these options seems relevant to you, then yes – your degree qualifies for Tier 2 visa sponsorship.
If neither option seems relevant or both do then it may be worth checking with a Tier 2 sponsor such as HCS Global Recruitment about whether or not your particular area of expertise could count towards a shortage occupation (and therefore whether sponsoring you would qualify them for sponsorships).
How to apply for Tier 2 (General) visa sponsorship
Under tier 2 visa sponsorship, you can work for a specific UK based employer without having to qualify under any of the other main immigration categories.
To apply for a Tier 2 (General) visa, an employer must first be licensed to sponsor employees for visas in that category and you have to have a valid job offer from them.
You must also demonstrate that your skills are such that your employment will not harm or replace local workers and that there is no suitable resident who could do your job instead.
And once you’ve completed five years in continuous employment on a Tier 2 visa, you may be eligible to apply for permanent residence (settlement).
What are Tier 2 visas?
Tier 2 visas are issued to skilled workers from outside of Europe who want to live and work in the UK.
If you have a job offer for graduate or skilled work, or you’re working for an approved company, your employer can apply for a Tier 2 visa sponsorship licence on your behalf.
Your employer can give you a certificate of sponsorship if: You have been offered a permanent job (at least 24 hours per week), that is genuinely full-time, paying at least £30,000 per year (or its equivalent).
There is no worker in Britain who can do that job as well as you. This means that someone already living in Britain, or already working for another company here cannot be swapped into your job so someone else can do it instead of you.
What does Tier 2 (General) visa mean?
The Tier 2 visa is for individuals who have a confirmed offer of employment from a UK employer.
For example, your Tier 2 visa would be granted to you if you have been offered a job as a graduate software engineer in London by a UK-based company.
The terms sponsored and Tier 2 mean that your employer must apply for permission on your behalf for leave to enter or remain in Britain.
In contrast, applicants under Tier 1 are those already in possession of one of five types of ‘points-based’ visa, and need not be sponsored by an employer.
Points-based visas (such as the highly skilled migrants) are awarded depending on how many points they score through things like age, previous earnings or qualifications.
Applying for Tier 2 visa sponsorship as graduate
If you’re applying for Tier 2 visa sponsorship as a graduate, you need to know that there is no shortage of graduates in science, technology, engineering and maths (STEM) roles.
This means that it’s more difficult to get your visa application approved because it’s considered ‘high-skilled’ work.
To get sponsored for a Tier 2 Graduate Visa, you’ll have to meet several criteria: have a degree (any level), be eligible for either graduate-level entry clearance or postgraduate training, apply from outside of the UK, show your ability in English and be able to support yourself financially without needing government support during your stay.
Getting a Tier 2 Work Permit as a graduate
If you want to stay in Great Britain after graduating, there is a process you need to follow to obtain a Tier 2 (General) visa sponsored by your employer.
This visa will allow you to live and work in Great Britain for up to three years.
There are certain eligibility requirements that must be met and documentation that must be submitted. The process can take several months.
Eligibility requirements for Tier 2 (General) visa application
You must be outside UK at time of application. You must have a qualification that is recognized by UK Border Agency.
You must have a certificate of sponsorship from your employer in order to be eligible for visa application.
Your employment or training place offered should not be full-time, you are allowed to work or train for 20 hours a week during term time and 40 hours a week during holidays.
